MATCHPOINT40 – TERMS & CONDITIONS

These Terms & Conditions (“T&C”) constitute a binding agreement between the Client and J&C Sports & Coaching LLC, doing business as Matchpoint40 (“Matchpoint”). By booking, purchasing, or participating in lessons, training sessions, or any other services provided by Matchpoint40, the Client acknowledges that they have read, understood, and agreed to be bound by the following provisions.


Acceptance of Terms

By accessing or using Matchpoint40’s services, the Client accepts these Terms in their entirety. Matchpoint40 reserves the right to update, amend, or replace any part of these Terms at its sole discretion, with or without prior notice. The most current version will always be available on the official Matchpoint40 website or application. Continued participation in lessons or services after any such modification shall constitute the Client’s acceptance of the revised Terms.


Privacy and Use of Information

Matchpoint40 may collect personal information, including but not limited to contact details, payment information, and relevant medical disclosures. Such information is used solely for scheduling, communication, billing, and safety purposes. By providing this information, the Client consents to its collection and use in accordance with Matchpoint40’s Privacy Policy.


Services Provided

Matchpoint40 offers a comprehensive program of racquet-sport training that may include private tennis lessons, semi-private and group sessions, structured drills, strategy development, match play, and customized fitness programs designed to complement racquet performance. Lessons may be conducted at various courts or facilities as arranged by Matchpoint40. While Matchpoint40 strives to provide high-quality training tailored to each Client, the Client acknowledges that results may vary and no guarantee of performance improvement is made.


Session Duration and Scheduling

Unless otherwise specified, each lesson will last sixty (60) minutes. Sessions will be scheduled at times and locations mutually agreed upon by Matchpoint40 and the Client, subject to the availability of coaches and courts. Matchpoint40 endeavors to accommodate scheduling preferences but cannot guarantee availability at all times.


Training Programs and Coach Assignment

All programs are designed with consideration of the Client’s age, current fitness level, prior experience, and specific goals. Coaches are assigned according to expertise and availability, and Matchpoint40 reserves the right to reassign or substitute coaches at its discretion. A change of coach shall not constitute grounds for cancellation or refund.


Client Obligations

In order to participate safely, the Client agrees to disclose any relevant medical history or physical conditions prior to commencing training. The Client further agrees to follow all instructions provided by the assigned coach and to abide by facility rules at all times. Failure to do so may result in suspension or termination of services. Prior to beginning participation, all Clients must sign an Informed Consent and Waiver of Liability.


Payments and Fees

All lessons and services must be paid in full before the start of the scheduled session. Pricing is published through Matchpoint40's official platforms and may be adjusted from time to time. In the event that payment has not been completed within seventy-two (72) hours of a scheduled lesson, Matchpoint40 reserves the right to process the outstanding charge using the payment method on file. By accepting these Terms, the Client expressly authorizes Matchpoint40 to process such payments as necessary.


Cancellations, No-Shows, and Weather Policy

Cancellations for private lessons made on the same day as the scheduled session will result in a charge of fifty percent (50%) of the lesson fee. Confirmed group or semi-private sessions cancelled less than forty-eight (48) hours prior to the scheduled start time will be charged in full. Clients who fail to attend without notice (“no-shows”) will likewise be charged the full lesson fee.

If weather conditions prevent the lesson from starting, no charges will be applied. Should weather cause cancellation within the first fifteen (15) minutes of play, the session will not be charged. If more than fifteen (15) minutes of the lesson have taken place before cancellation, the full lesson fee will apply, but any unused portion of time will be credited toward a future session.


Assumption of Risk and Injury Disclaimer

The Client acknowledges that participation in racquet sports involves inherent risks, including but not limited to slips, falls, overexertion, collisions, contact with equipment, and exposure to weather conditions. By engaging in Matchpoint’s services, the Client voluntarily assumes all risks associated with training and play.

The Client expressly agrees that Matchpoint40, J&C Sports & Coaching LLC, its owners, directors, employees, coaches, and affiliates shall not be held liable for any injury, accident, medical complication, property damage, or death sustained before, during, or after participation in any activity. This waiver of liability extends to injuries resulting from falls, sprains, strains, fractures, head trauma, heat exhaustion, or any other unforeseen accidents.

The Client understands and accepts full responsibility for their own safety and well-being, agrees that participation is undertaken at their own risk, and acknowledges that they are solely responsible for maintaining adequate health and accident insurance coverage. By enrolling, the Client waives any right to pursue legal action against Matchpoint40 for injuries or damages that may occur.


Health and Safety Requirements

By agreeing to these Terms, the Client represents that they are in good physical health and know of no medical condition that would prevent their safe participation. Should any health condition, injury, or illness arise that could impact safe training, the Client agrees to notify Matchpoint40 immediately. Matchpoint40 reserves the right to suspend participation if, in the judgment of its coaches, continued participation may pose a risk to the Client’s health.


Facility and Equipment Use

All facilities and equipment provided by Matchpoint40 must be used responsibly. Clients are prohibited from misuse, abuse, or negligent handling of property. Any damage resulting from such conduct shall be the financial responsibility of the Client. Repeated misconduct may result in suspension or termination of services without refund.


Media Consent

Matchpoint40 may occasionally photograph or record lessons for promotional, educational, or training purposes. By participating, the Client grants Matchpoint40 permission to use their image, likeness, or performance in such media, without expectation of compensation. Clients who do not wish to appear in media must submit a written request in advance.


Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these Terms shall be resolved exclusively through binding arbitration conducted in Miami-Dade County, Florida.


Acknowledgment

By hiring the services, the Client confirms that they have read, understood, and voluntarily agreed to the Terms & Conditions, including the Assumption of Risk and Injury Disclaimer. The Client further acknowledges that participation is entirely voluntary and undertaken at their own risk.
